1. When do these Terms apply?

1.1. Who is the contracting party?

Your contracting party is SellBricksOnline, an independent LEGO® brick buyback service. SellBricksOnline is not affiliated with, authorized, or endorsed by the LEGO Group. LEGO® is a trademark of the LEGO Group, which does not sponsor, authorize, or endorse this website or its services. We reserve the right to assign our rights and obligations under these Terms without requiring your consent.

1.2. Who do these Terms apply to?

These Terms apply to any individual consumer who chooses to enter into a transaction with us by selling LEGO® bricks to us within the United States. To participate in the SellBricksOnline program, you must be at least 18 years old. As a condition of participating, you must be the owner of the LEGO bricks that are the subject of the transaction and/or have the legal right to transfer title of these bricks to SellBricksOnline.

1.3. Can I sell bricks if I act as a business?

No, we only offer to buy LEGO® bricks from individual consumers. All legally recognized entities, including businesses, government agencies, non-profits, associations, partnerships, and other corporate entities, are explicitly excluded under these Terms.

2. What is the SellBricksOnline program, and how does it work?

2.1. What is SellBricksOnline?

SellBricksOnline is a LEGO® brick buyback service. We buy your loose, used LEGO bricks so they can find a new home and continue to be enjoyed. Sell back your bricks and help give them a second life.

2.2. How can I sell my LEGO® bricks?

You may sell your LEGO® bricks to us by requesting a free shipping label through our website at www.sellbricksonline.com. Once you receive your pre-paid shipping label, you simply package your bricks and drop them off at the designated shipping carrier location. We will handle the rest.

2.3. When do I enter into a contract with you?

When you request a shipping label and subsequently ship your LEGO® bricks to us, you enter into a legally binding agreement with SellBricksOnline. By sending in your bricks, you agree to accept the payout values determined by SellBricksOnline, without expectation of any item return. The actual payment amount will be calculated once we receive your package, examine the contents, remove any ineligible items, and calculate the actual weight of eligible bricks.

2.4. What kind of LEGO® bricks are eligible?

We specifically buy LEGO® bricks, elements, and baseplates that have been used. We do not expect your bricks to be in mint condition. However, we reserve the right to reject any LEGO bricks if they are not in reasonable condition. Bricks are not in reasonable condition if we determine, in our discretion, that (a) an appreciable number are cracked and/or significantly worn, or (b) the bricks may pose a health or safety risk.

2.5. What items are ineligible?

We are not able to accept the following items:

• Non-LEGO® bricks and elements
• Assembled LEGO sets or connected bricks
• LEGO DUPLO® bricks and elements
• Electronic components or batteries
• Any other LEGO branded items such as apparel, key chains, storage containers, building instructions, and packaging

We strongly encourage you to remove any ineligible items before packaging your bricks. For mail-in transactions, any ineligible bricks, elements, or other items will be removed prior to calculating weight and will not be returned to you. We reserve the right to change the list of ineligible items at any time and for any reason in our sole discretion.

2.6. Packaging requirements

It is your responsibility to ensure adequate and secure packaging of your LEGO® bricks for transportation. Bricks must be packaged in cardboard boxes that are in excellent condition and rated for the weight of their contents. Bricks must not be packaged in other receptacles such as polybags, plastic totes, etc. Maximum accepted package weight is 45 pounds. Packages that fall outside accepted limits will be handled at our discretion.

2.7. Transfer of title

The title to the LEGO® bricks and any other contents of your package shall transfer to SellBricksOnline upon receipt of your package by the shipping carrier. Once the package ships and is on its way to us, you shall not retain any title to the bricks or any other items included in the package. We will not return any bricks or items that we deem, in our discretion, are ineligible. We encourage you to carefully review the contents of your package before shipment.

3. How does payment work, and how do I get paid?

3.1. How is the price determined?

The price we offer for your LEGO® bricks is determined by the weight of the eligible bricks. Any means of storage (e.g., bags or boxes), non-genuine LEGO bricks, and other ineligible items listed in Section 2.5 are not taken into account when determining the weight. The prices we offer per pound (lb) may vary and are subject to change from time to time. We reserve the right to make changes to our pricing at any time and for any reason in our sole discretion.

3.2. How will I receive payment?

Once we receive your bricks, examine the contents, remove ineligible items, and calculate the actual weight of eligible bricks, we will determine the final payment amount. Payment will be issued to you via the method specified at the time of your transaction. Payment methods and amounts are determined at our sole discretion and may change at any time.

4. Limitation of Liability

SellBricksOnline is only liable for loss or damage due to gross negligence. In no event will SellBricksOnline be liable for any direct or indirect, incidental, statutory, exemplary, punitive, special, or consequential damages as a result of any claims, whether arising under tort, breach of contract, strict liability, or otherwise, related to your participation in the SellBricksOnline program.

SellBricksOnline disclaims any and all warranties to the fullest extent permissible under the law. Our total aggregate liability arising out of or related to these Terms shall not exceed the total amount paid or payable to you in connection with the specific transaction giving rise to the claim.

SellBricksOnline shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, loss or malfunction of utilities, computer or telecommunications failures, or shipping carrier delays or errors.

5. What should I do if I am not satisfied?

If you are not happy with your SellBricksOnline experience, we invite you to reach out to us at hello@sellbricksonline.com and we will try to find the best solution to address your concerns. We typically respond within 24 hours.

6. Governing Law

These Terms and all matters arising out of or relating to these Terms are governed by, and construed in accordance with, the laws of the State of New York, United States of America, without regard to the conflict of law provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than those of the State of New York. As you are contracting as a consumer, this will not affect your statutory rights. The UN Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

7. Intellectual Property

All content, features, and functionality on the SellBricksOnline website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of SellBricksOnline or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

LEGO® is a trademark of the LEGO Group, which does not sponsor, authorize, or endorse this website or its services. All other trademarks, service marks, and trade names referenced on this website are the property of their respective owners.

8. Indemnification

You agree to defend, indemnify, and hold harmless SellBricksOnline, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the SellBricksOnline website and services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (d) any claim that your bricks contained hazardous materials or items not disclosed to SellBricksOnline.

9. Modifications to these Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and services.

10. General Provisions

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and SellBricksOnline regarding the use of our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
